These terms cover what FlashTap is, how the subscription works, what you own, what we own, and what happens if either side wants out. Written by us, not a lawyer. If something doesn’t make sense to you, reply to hello@flashtap.ink and we’ll fix it.
What FlashTap is
FlashTap is a SaaS for tattoo artists. You upload your flash; we ship you a pre-programmed NFC tag that you stick at your chair; clients tap it with their iPhone and a native App Clip shows your gallery for a short window (default 10 minutes) with screenshot protections active.
By using FlashTap (the website, the dashboard, the iOS App Clip, and our APIs) you agree to these terms.
Account + eligibility
You must be 18 or older and a working tattoo artist (or working on becoming one) to create a FlashTap account. You’re responsible for keeping your password safe. If someone else logs in as you and uploads things, that’s on you, not us — but tell us right away and we’ll help untangle it.
Subscription + billing
FlashTap is a paid subscription. The current plans:
- $10 per month, billed monthly. Cancel anytime.
- $99 per year, billed annually. Cancel anytime; refund prorated to month.
- $399 one-time lifetime license, available only to artists who’ve earned Founding Sponsor status (3 referred paid subscribers). After this, you’re never billed for the subscription again.
The first NFC tag and a second backup tag are included free with every new subscription. Additional tags are $10 each, capped at 10 per order. The first replacement tag (if yours arrives broken or is lost) is free; subsequent replacements are $10 each.
You get a 7-day trial when you sign up (30 days if you came through someone else’s referral link). At the end of trial we charge the card on file. We don’t send a reminder email — Stripe’s system will, and you can check your trial end date on the dashboard at any time.
One-time charges (additional tags at signup or dashboard reorder, lifetime license) are billed immediately at checkout, including during your subscription trial — because those are physical or grants, not recurring service. Subscription billing still respects the trial.
Cancellation + refunds
You can cancel your subscription at any time via the Stripe billing portal we link to in your dashboard. Cancellation takes effect at the end of your current billing period; your tag stays live until then.
We don’t proactively refund partial periods or charge back never-activated tags. If something genuinely went wrong (we shipped to the wrong address, the chip arrived dead, your gallery never loaded for a tap-eligible client), email us and we’ll make it right — refund, replacement, or credit, your call.
One-time charges (additional tags, lifetime license) are non-refundable once the label is purchased or the lifetime license is granted, because those are physical or terminal grants we can’t take back. Defective tags get a free replacement under the policy above.
Your content
You retain all rights to the flash you upload to FlashTap. You’re granting us a limited, non-exclusive license to host, render, and display it through the FlashTap App Clip and your dashboard, for the duration of your subscription. That license ends when you cancel or delete your account, at which point we delete your uploaded flash from our storage.
You promise that what you upload is yours to upload — either you drew it, you have the artist’s permission, or it’s in the public domain. If a third party tells us you don’t have the rights, we’ll act on a valid DMCA notice.
The NFC tag itself
When we ship you a programmed tag, you own the physical chip. The URL written to it points at FlashTap’s viewer; we control that URL’s routing. If your subscription lapses, the tag won’t show flash — it’ll show a polite “gallery offline” message. Reactivating brings it back.
The chip is locked when we ship it, which means the URL can’t be overwritten by someone else tapping with a writer app. You can’t reprogram it either — that’s the point of the lock.
Acceptable use
You may not use FlashTap to host, distribute, or otherwise promote content that:
- You don’t have rights to (copyright infringement).
- Is illegal, hateful, harassing, or sexually exploits minors.
- Impersonates another artist or shop.
- Spams clients with anything beyond the gallery view.
You may also not resell FlashTap subscriptions, scrape another artist’s flash through the App Clip, or attempt to bypass the screenshot defenses.
Termination
You can cancel anytime. We can suspend or terminate accounts that violate the acceptable-use rules above, that chargeback subscription payments without first reaching out to us, or that we have reasonable cause to believe are engaged in fraud.
When an account terminates, we delete your flash and deactivate your tag. We retain billing records as required by US tax law and anonymous view-session aggregates for our internal analytics.
Disclaimers + liability
FlashTap is provided “as is.” We do our best to keep the App Clip fast, the chip working, and your flash available — but we can’t guarantee uninterrupted service or that every device on Earth will tap-launch correctly. iOS-only by design; non-iPhone visitors see a friendly “iPhone required” page.
To the maximum extent permitted by law, our total liability to you for any claim related to FlashTap is limited to the amount you paid us in the prior twelve months.
Changes + governing law
We may change these terms. When we make a material change we’ll email active artists before it takes effect, and the effective date at the top of this page will update.
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute that can’t be worked out by emailing us first will be resolved in the state or federal courts located in California.
